Restrictions
You may not modify, reverse engineer, decompile, or disassemble any part of ActiveApp, except to the extent that such activity is expressly permitted by applicable law. You may not rent, lease, lend, sell, or redistribute ActiveApp, or use it in any manner not expressly authorized by this Agreement. You may not remove or obscure any copyright or other proprietary notices contained in ActiveApp.
Ownership
ActiveApp is protected by copyright and other intellectual property laws and treaties. We retain all rights, title, and interest in and to ActiveApp, including all intellectual property rights.
You may not copy, reproduce, distribute, publish, display, perform or create derivative works of the ActiveApp.
Upgrades and Support
We may provide upgrades, updates, or other support for ActiveApp at our sole discretion. We reserve the right to discontinue support for a ActiveApp at any time, without notice to you.
Use of Services
You agree to use the Services only for purposes permitted by these Terms and any applicable laws, regulations, or generally accepted practices or guidelines in the relevant jurisdictions, and your use of the Services.
We may terminate this Agreement, stop providing the Services, and take any lawful action with users in the event of:
- performing actions that may be offensive, illegal, or violate the rights, harm, or threaten the safety of any person;
- carrying out activities that disrupt the operation of the Services;
- spamming;
- infringe copyrights or other intellectual property rights;
- violation of the terms of this Agreement;
- using the Services to violate the law.
Disclaimer of Warranties
ActiveApp is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. We do not warrant that ActiveApp will meet your requirements or that the operation of ActiveApp will be uninterrupted or error-free.
Limitation of Liability
ActiveApp provides the services "AS IS" and "AS AVAILABLE" without any warranty. In no event shall we be liable for any damages (including without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use or inability to use ActiveApp, even if we have been advised of the possibility of such damages.
Your access to and use of the Services is at your own risk. If you are dissatisfied with the Services, your sole and exclusive remedy is to discontinue using the Services.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflicts of law provisions. Any legal action or proceeding arising out of or relating to this Agreement or ActiveApp shall be brought exclusively in the courts located in Tallinn, Estonia, and you hereby consent to the jurisdiction of such courts.
Termination
This Agreement is effective until terminated. You may terminate this Agreement at any time by discontinuing use of the Services. We may terminate this Agreement at any time if you breach any of its terms and conditions.
Changes to Agreement
We reserve the right to modify or amend this Agreement at any time without prior notice to you. You can view the most current version of this Agreement by visiting our website. Your continued use of ActiveApp any such modification or amendment constitutes your acceptance of this Agreement as so modified or amended.
